The European Commission has commenced an evaluation (a so-called 'fitness check') of the effectiveness of the EU regulation on substances that deplete the ozone layer ("Regulation (EC) No 1005/2009 of the European Parliament and of the Council of 16 September 2009 on substances that deplete the ozone layer, hereinafter "the ODS Regulation"). This evaluation might cause the Commission to submit proposals for a revision of the regulation.
The ‘fitness check' looks at whether the legislation remains relevant in light of developments such as the availability of new alternatives to ozone-depleting substances. It is intended to ensure a higher level of ambition in the EU "where technically and economically feasible". Specifically, the evaluation will:
